台灣商標案件法律最高主掌的智慧財產法院判決理由：竟然舉小茶農先已註冊於茶葉30類別的產品介紹，判定茶葉有保健效果，所以是屬於藥品類別的藥用茶！據以撤銷小茶農保健05類別部份商標(與大藥廠有衝突部份)。
The Supreme Court in charge of intellectual property rights brought in a verdict that tea products registered by that tea farmer carrying the effect of health care should be grouped as ‘medical’ tea. Therefore, the court revoked the trademark registration and health care G.5 from the tea farmer (Indeed, the parts that have a conflict with that well-known pharmaceutical factory)

The court even brought in a verdict that the well-known tea drink in Taiwan is categorized as a kind of ‘drug.’ If the verdict is finalized at the end, in Taiwan not only tea leaf, but also coffee bean, would be categorized as a kind of ‘medicine.’ This tea farmer has no way to appeal, so he decides to appeal his case to Youtube

我認為問題應該不是在茶葉本身~
而是在於跟茶葉有關的產品上~~~
因為如果單純的茶葉被歸類為藥品~
那台灣有多少賣茶葉的店家要關門~
而且在台灣又是一條社會大新聞~~ -
